Balancing Individual Interests and the Common Good
The Constitution holds a natural tension between “the general welfare” and “the blessings of liberty.” To what extent can a government legitimately constrain individual freedom in favor of the common good? At what point do such restrictions threaten its citizens’ fundamental rights?
