Balancing Individual Interests and the Common Good

The Constitution holds a natural tension between “the general welfare” and “the blessings of liberty.” To what extent can a government legitimately constrain individual freedom in favor of the common good? At what point do such restrictions threaten its citizens’ fundamental rights? In the face of a global pandemic, increasing inequality, and climate crisis, the way we approach these fundamental questions is critically important.
